    CSC to NVC

    thanks dentyne. Yes, you should wait for your case no. to be generated and then preferably which ever NVC operator gives you the case no., ask them if you can address the fax/letter to their attention. I think that will help a lot. Also, the last time when I spoke to the NVC operator and asked her if I need to send the fax she said no. And then, they sent this letter. So I guess in any case, you should send in the CP fax confirmation. You have nothing to lose.

      Case Number

      Hi bd850,

      I'm confused. The case number created by NVC is indicating your consulate. In my case it's TKY2000xxxxx (Tokyo). I got this number the day after the automatesd message has changed. That means NVC knows that I opt for CP, and I don't have to make sure whether CP or AOS. Is that correct? It's kind of strange if NVC doesn't know what to do at this point.
      So your information was entered into the NVC database, but NVC didn't create your case number because NVC didn't know what to do??? Tha's why NVC is sending a letter to you? Is that correct? If you opt for CP, your case number should have created.

        I-140 Approval Notice

        Hi bd850,

        What does your I-140 approval notice say?
        Mine doesn't say anything about AOS, and says "Consulate: Tokyo".

          AOS or CP letter from NVC

          The letter from NVC asking for a decision on AOS or CP is sent only to those cases where priority date is before March'98 (NVC Operator info). So anybody having priority date after March'98 need not worry about such a letter.

                    Generally when we talk to NVC operator they say that Packet 3 has been printed on such and such date, but that does not mean that packet 3 has been sent on that date, but usually the packet 3 sent a couple of weeks after it is printed (don't know why, but it is). So when you talked to NVC operator so did he/she said the packet 3 has been sent or packet 3 has been printed?

                    For AOS/CP, as I have mentioned the Feb98 is the criteria, so if your PD is current and PD is dec97 then NVC will send that letter, but if your PD is current and PD is apr98 then NVC will not send this letter and process your case for CP.

                      She never told me that the Packet3 was printed on that date, so I have no idea about what you mentioned above.
                      She said clearly, "Packet3 was sent to Santa Barbara (where I live.) yesterday, and your files were also sent to Tokyo consulate." after I told her my case number...

                        packet 3

                        I called the NVC today and what an earlier post (It was from Robin Singh) said about printing of packet 3 seems to be true for me as well. The operator told me that they have generated my packet 3 today. She told me that it will be mailed to my attorney and the consulate in approximately 10 days.

                        Robin: Did you get your packet 3 ? If yes, how long did it take for you, after NVC said they had generated packet 3 ?

                          thanks RobinSingh for that information. My PD is Nov. 96 and I was wondering as to why NVC has sent me that letter. Now its clarified...

                            Hi guys,

                            My attorney has already received the packet3 from NVC.
                            I don't know when, but NVC sent it to 12/19/00.
                            I just wanted to let you know.

                                NVC Packet 3 Sent - ?
                                NVC Sent Case to Consulate - ?
                                Attorney Received Packet 3 from NVC - ?
                                I Received Packet 3 from my Attorney - ?

                                Note that the "NVC Created Packet 3" date above is 12/25/00 which is Christmas Day!! I asked the operator about this and he said that the Packet 3 was generated automatically when they ran a batch process on 12/25/00. He could not tell how often this automated "batch" process is run. From Hiro 32's (his Packet 3 created at NVC on 12/11/00) and my experience, I am guessing that this mysterious "batch" process to generate packet 3 is run once a week (or fortnight) on Mondays. Notice that, in Hiro32's case 12/11/00=Monday and in my case 12/25/00=Monday.

                                My Packet 3 has not been sent by NVC yet. I was told that it will take 1 to 2 weeks to forward my case to my consulate (Mumbai), at which time they will also send the packet 3 to my attorney.

                                A Request: The NVC operators are very nice and helpful. Please be as polite and considerate as you can be while talking to them. Thanks.
