Case Type - I-130 Married daughter (residing in Caribbean) of US citizen.
Priority Date - April 26, 2001 (TSC)
Transferred to CSC October 2006
Approval date - March 27, 2007
Just got approval letter in the mail. My mother used a lawyer who moved office and so the mail was returned and later resent. Lucky for me I got emailed notice long ago. So we had informed the lawyer who cannot find our file (no copy of the petition, I-797 form, nothing!)since the move. We are telling him goodbye.
Strangely - seeing as I don't live in the US - the notice states: "The above petitin has been approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status." He or she should obtain a Form I-485, Application for Permanent Residence.
It goes on to say "If the [person for whom you are petitioning decides to apply for a visa outside the US based on this petition the petitioner should file Form I - 824. Application for Action on Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center (NVC).
I downloaded the I-824 form but the form has no option for the applicant to request that we send the petition to the Department of State National Visa Center (NVC). The only relelvant options appears to be that we notify a different US consulate (since I don't live here) of the approved petition.
So what do I do? Should I complete the !-824 form and ask that the US consulate in my home country be notified of the approved petition or should I just wait and assume that the NVC will be notified about my case by the CSC. Mu mum is surprised that they are suggesting I am in the US as I have only visited but she recalls the lawyer asking if I would collect the visa here and she said yes. Now is there going to be a long delay with this I-824 form or can we just ask CSC to forward the form to NVC.
