I have applied for I-140 and awaiting approval within a month or so based on current processing times.
I want to take the CONSULAR PROCESSING route but I have had a CRIMINAL CHARGE against me, its of the "VIOLATION" category (not FELONY) for ATTEMPTED ASSAULT & HARASSMENT: DEGREE 3. As of now I have no criminal charges , but the fact that I was charged still remains in my background.
Please advise if this poses a risk if I took the CP route instead of ADJUSTMENT OF STATUS(AOS).
