  • Consulate changed from New Delhi to Chennai

I am going through consular processing and requested New Delhi as my consulate, as I am from that area and I had received my initial visa to come to the US from there. The from I824 from INS to the NVC mentioned that the consulate is New Delhi.

However, I was surprised and stupified when NVC assigned my case to the Chennai consulate. Has anybody had a similar experience? Is this a mistake? Can it be rectified? Are they assigning consulates at their own discretion now?

It is better to be in ones own comfort zone than going to a new place altogether.PLEASE HELP!!

    Procedure

Please consider that the consulate is assigned based on the address in your passport and not based on from where you took the last visa.

For me also the NVC first assigned my case to Bombay consulate and even gave me the case number for Bombay starting with BMB2000xxxx. But when I called them 2 weeks later then they had reassigned my case to New Delhi as my address fell under the Delhi consulate and gave me another case number starting with NWD2000xxx.

I had this problem too. Mumbai->Chennai. It took me
6 weeks to get a new case number from Chennai
consulate. I dont know how Robin got a new case number
from NVC, my lawyer had said that the case number
comes only from the new (correct) consulate in the event
of NVC making such a mistake.

Robin: How did NVC people get hold of your passport and the address mentioned therein to reassign your case to a different consulate other than mentioned in the 824 approval? I don't think NVC by any chance get any copy of the passport to get the address.

        Thanks

Meenu is right. How can NVC get that information about your adress on the passport? Anyway, even on my passport, the adress corresponds to the jurisdiction of the New Delhi consulate.

I called up NVC and told them to rectify the mistake. They wanted a letter from me and my lawyer, which I sent promptly. I am now waiting for their decision.

Re: I140 Part 4 contains the India Address Info

I guess the India address information is in I140 Part 4 which is accessible to NVC. In my case, I didn't do anything but NVC corrected by itself (I never called them regarding this, in fact initially was I happy that they have assigned my case to Bobmay), so I guess they must be having the required information to make a decision as to assign the case to which consulate.

              Hi Junaid870,
I would like to know at what stage did you get to know that your consulate has been changed? Can you let me know your details? I am from Mumbai consulate jurisdiction and hoping to get my case assigned to Mumbai consulate. But at the same time I am aware of the unforutnate situation that you went through.

I called up NVC an dthey have received my case on Feb 28th. May I know how long did it take for NVC people to creat ethe case numvber etc and the procedures. My case is also same as yours, I mean to say is 824 approval.

              Please reply

              Thanks

                reply to meenu

                Hello Meenu,

I got the information of my consulate change when NVC sent a letter to my lawyer asking whether I wanted to got through adjustment of status or consular processing after they had received the I 824 from the INS. (I dont know why they needed to ask, as it was clear from the I 824 that I wanted to go through consular processing).

I have contacted NVC to rectify this and am still waiting for them to do so.

                Junaid
