can I send packet3 before getting it from NVC ?

Hi,
My PD is current, can I send packet3 to consulate before I get it from NVC ? Has anyone done it ? I chose CP on I-140.
On form OF-169 can I mention I-140 reciept no as I dont have a case number.

You should only send in your pkt.3 before you receive yours from NVC if:

1) NVC has created your case and you have a case #
2) and the Consulate has recd. your case from NVC

From your post, it seems you dont even have the case # from NVC. So you must get your case # from NVC. Then when you come to know that your case has been sent to your consulate, call up the consulate and confirm with them. Then go ahead and send in your pkt.3. You need NVC case # and not I-140 #.

Today they said at NVC that they recd. my file on feb6.
When can I expect the file to be sent to Mumbai consulate ?

1) Now that NVC has recd. your file, it will take them around 3-4 weeks to create your case.
2) once they create your case a case # will be assigned to you.
3) Within 2-3 weeks of creating your case, pkt.3 will sent out to you and your case sent to you consulate. So I would say, your file should reach Mumbai not later than during the month of April.

So this will be the approximate timeline. But it all depends upon the load at NVC, but they are pretty efficient and reliable.
