  • I-824 Meager Reciept is not sufficient

    My attorney says that "Eventhough Consulates are asked to process CP based on Receipt of filing of I-824, it is ONLY in theory. Most Consulates need actual approval of I-824."

    I know that most people could get through Mumbai by just having I-824 Receipt.

    What do I do?
    Can anyone send me a link which can contradict the statement.

    I would liek to know which consulate do you belong to. If it is Madras or Delhi then forget about AC-140 and go for AOS. Madras and Delhi consulates don't accept AC-140

      No Meenu. I am from Mumbai. I stayed there for my whole life. I guess you are from Mumbai too.

        This is waht the exact extract of the Department of State Memo on Consular Processing directing the consulates to process the IV

        The visa office requests that posts which process IV's begin immediately accepting I-140 cases for which the beneficiary has filed an I-824 request for overseas processing and was last resident in posts's consular district. As noted above, such cases are not discretionary. If post is approached by a beneficiary or atroney requesting such processing, post should first determine if the beneficiary is eligibile to ahve the case processed there. Posts do not have to have the actual approved petition to process, as 9 FAM 42.42 authorizes officers to process immigrant visa petitions on the basis of an I-797 "notice of approval" or telegraphic notification of petition approval. For the sake of consistency as well as forestall potential fraud, posts must accept these cases only if the beneficiary can supply all of the following items:

        Original I-797 notice of the I-140 petition.
        Copy of the I-140 petition(a certified copy is not necessary).
        Receipt for the I-824 to demnostrate the applicant has requested overseas processing.
        Evidence the applicant was last resident in the host country of the post

        If you are from Mumbai consulate you need not be worried. There are so many messages in thsi message board that says that 824 receipt is only required for AC-140. I am not from Mumbai but comes under Mumbai consulare district. So I have to go to Mumabi and have applied for 824 and yet to receive the receipt from INS. BTW my priority date has not eocme current it is Sept 2000 and I guess I have time till I receive the 824 receipt and file AC-140 with Mubai with that receipt.
