  • Please help with AC I-140 and I-824

    I got my I-140 approved, I don't know if it noted CP (= consular
    process) or AOS (= adjustment of status), though my lawyer knows that,
    but I do know that I-824 was filed and approved. My file did not reach
    NVC yet. I am middle-eastern.

    My questions are:
    1. If my consulate accepts "attorney certified copy", then is it
    required or not to have been filed I-824? Is I-824 receipt required?

    2. Is it true that I-824 is usually an unnecessary step for CP?
    If I-140 request noted CP preference, then I-824 is not necessary?

    3. If I-140 request noted CP preference, is it possible to bypass NVC
    using an "attorney certified copy"?

    I really need to understand this, to make sure my lawyer is doing the
    right thing and time is not wasted.

    Abu, firstly, if your attorney filed I824 then that means your I-140 was approved for AOS and hence he filed I824 in order to do CP. So, if your consulate accepts Attorney Certified AND your I-140 says AOS, then you can go ahead with your AC-140. For your country, I am not sure whether AC-I824 is required but for us (Mumbai) requires it. But in your case since you already have an I-824, you should just send it along.

    Yes, you are right. If your I--140 says CP, then you dont need I-824. I-824 is only required if you want to change from AOS to CP or do AC-140 (at least its reqd. for Mumbai)

    As far as I know NO, you cannot bypass NVC. At least for us people from India, Mumbai consulate will not accept AC-140 if your I-140 says CP thru' NVC. Then, Mumbai will wait for the file to come from NVC.
