  • US Embassy Manila-IR3 Visa refusal under 221g

We adopted our daughter in June of 2006 in the Philippines. My wife and I are both US Citizens. Our I-600 petition was approved in August of 2006. Our daughter had a visa interview in Manila in April of 2007. She was refused a visa under section 221g of the Immigration and Nationality Act. No mention was made of lacking documents. Our US Senator's Office inquired as to her status in June of 2007. The response from the US Embassy Manila was that her case involved further processing. (whatever the hell that means), and that she would be informed when they were done with this. The only bright spot in this story seems to be that the US Embassy/Manila, took our daughter's passport.
My question is; just what is this "further processing?, and how long does it take? We have been waiting now for almost 5 months. Any answers or information would be greatly appreciated. The US Embassy in Manila seems to be very evasive, and very non responsive.

      thanks for the reply

thanks for the reply. I didn't think anyone was out there in this forum. 5 months and counting, and still we haven't heard a word. We're hoping for the best, and try to have patience, but it is difficult. The only bright spot would be that they took our daughter's passport, so hopefully we can expect some action in the not too distant future.

It's now been 6 months since our daughter had the visa interview in Manila, and was placed on 221g administrative review and further processing. Does it ever end? How long is this supposed to take???????????

after 7 months of waiting under 221g administrative processing/review....our daughter has been told to appear at the US Embassy Manila to resume processing. They just said "interview" again. I wonder what they might be up to? Hopefully just a formality to finally release her visa. It took our US Representative to get this moving, and they said that "the investigation had been completed." Seems like 7 months should be enough time to complete it allright. Is this 2nd interview to release the visa or what? My brother in law and sister in law are the ones taking our 4 year old up to the Embassy. What might they encounter???? Would appreciate any insights....Thanks.

I'm glad finally they asked your daughter to appear for interview. It took 17 months for my father's 221g background/name check and he got visa couple weeks ago. The way I understood, if it takes more than 6 months you need to re appear and take oath finger prints etc. I'm sure they have sent letter to your daughter to bring some documents.

Yes, congressman helps alot, senator SUCKS. My area senator flately denied me helping in my father's case, so my vote is not going to her.

I wrote letters to Mr. Bush, Rice, and homeland security head, and I don't know who helped me.

Don't worry, your daughter will get visa and she will be with you soon, that will be a christmas gift for you.

If you need any assitance or question you can email me as well [email protected]

Thanks for the words of encouragement.....As far as we know, our daughter is still in Manila, and we haven't heard anything yet. It would be the best Christmas present ever, to be able to finally have peace of mind that her visa has been released.
A note of finality. After 8 months of waiting, the US Embassy Manila denied our daughter a visa. We had an approved petition, but I guess that didn't matter. We now have an adopted daughter that we can't bring to the US. This country sucks, totally and absolutely. We have 10-30 million illegals here demanding their rights....What about our rights? One dumb **** employee in the US embassy has ruined our lives. I'ts a long story but I'm so tired of hearing that the US Immigration System cares about children, when in fact its just a lot of hot air and total BS. Guess what? I've been teaching US Government for 27 years to high school students. I now have a brand new perspective on just how much this country sucks. I'll make sure to include that in my teaching from now on. Canada is light years ahead of the US in Immigration flexibility for adopted children in foreign countries. I actually see no recourse except to resume my Canadian citizenship and leave the US. Thanks to everyone who tried to help. I guess our journey through US Immigration hell is over.
