I am a beneficiary of I-245(i) petitioned under employment based visa, other worker category. I got my Green Card last March 2006 on AOS and USCIS also approved my I-824 for my wife and kids.
They were interviewed last December at the consular office but the consul asked for more documentation on how I was able to adjust my status here in the US.
The wife received two more RFE after responding to their first request which I promptly respond with the help of my lawyer.
Last August, they received their passport without visa but just a stamp of "Application Received" and no further explanation on reason why it was returned.
I called the embassy and was informed that the case was forwarded back to the US.
Is this a denial of the case? or maybe because there are no visas available on that category?
