  • steps required to do CP for wife while i am on AOS

    My 485 is pending and PD is current. Getting married soon and wife won't be able to come back with me...and she will join later. I was told there is option for her to do CP as long as we are legally married before my 485 is approved.
    Now my question is what do I need to do for her to be able to do CP while i will be doing AOS. She will not be in the US at all after marriage. Do i submit any form to USCIS for her? She just needs to go to consulate in home country after my 485 is approved and fill out the immigrant visa forms? Any info on it?
    I found alot of info on how to do CP if both of us decide to do the CP...but nothing really on what i need to do for her so she can do the CP and join me.

    Take a look at I-824 and google "follow-to-join"

      Thanks for the reply PraetorianXI.

      I looked at that I-824 and googled it also. On the form it says the form is to "provide further action on a previously approved petition or application" which means i can submit I-824 only after my 485 is approved and then wait for about a year for 824 to be approved (based on current processing time at NSC) and then she can start the CP? another 4~6 months i believe.

      I was under the impression that she can do the CP as soon as my 485 is approved and PD is still current...didn't know about waiting for a yr for 824.
