  • AOS to Consular Processing

    Hi,
This forum helped me a lot. Thanks for the senior members replying to the questions posted.
I am in 8 th year in H1B. I applied for my green card (labor) in Nov 2005. My I140 was approved and I485 was filled in Jul 2007 and pending with USCIS. I received my EAD card and I haven't used that to work. I am still in H1B. I and my daughter had medical examinations done in US and went for finger printing appointments. I am planning on moving to my home country.

    1) Is there any way I can switch my green card (AOS) to Consular processing? If so, if I apply I824 is that enough?

    Thanks
    Akil

That should be it for changing from AOS to CP and the case will be moved to your local consulate for processing. They will call you for the visa only when immigrant number becomes available.

Usually, CP cases are accepted only when the PD is current or close to being current. The transfer should work fine on a pending AOS case.

The case has to transfer from the service center to the consulate abroad.
