My husband and I interviewed together at Chennai for GC CP. His case was approved an he has moved to the US now. Mine had an RFE and got caught in the priority-date retrogression. Indefinite wait is expected - our priority date is 8th Nov 2004. Lawyer advises H-1 or F-1 as only hope for my travel.
In the past, I studied on F1, did OPT in the US then used under 3 years of my H-1 with 2 different companies. Now I have been outside the US for 2 years.
Does this mean a new H1 petition for me will fall under the annual quota rather than a H-1 transfer to the new company? If not, what is the earliest time that I can expect petition approval with Premium Processing (H1 quota reached already?)?
If H1 will take several months what are my other options? Should I risk F-1 application?
Am I eligible for a 'follow-to-join'? Or can I appeal my current GC scenario?
