  • rejection of visa for 212(a)(4)

I was wondering my stepson on an IR2 had his interview on the 28th. It was rejected due to my income in 2008. which was below the poverty level that was needed. My I-864 that I submitted to NBC and Visa proccessing center were fine. At the Consulate the only looked at 2008. My current income for 2009 is above the the amount needed. I showed pay stubs to prove it my income but they did not even consider my current income. they say I need a sponser. what can I do? and they also said that I needed a different Birth certificate. The one I have is issued from the county I was born in and certified but they will not accept that one either. Not sure of what I should do. Any info would be great.

    Thanks

Once you file your 2009 taxes, I wonder if it may be possible to then use that to demonstrate that you have sufficient income but I don't know. You could always ask at the Embassy/Consulate. Regardless, you must do whatever the Consular officer told you as that is the person you have to satisfy.

When you say your birth certificate is certified, was it certified by whatever government authority issued the original certificate? If so, I would think it would be acceptable but it is definitely not acceptable if it was certified by someone else.
