I am applying for a green card for my mother. She is 77 years old and has no one to take care of her in India. My brother (with whom she was living) died in March 2010 and hence I had to bring her with me. A couple of questions –
1) I am a US citizen and have filed a petition (I-130) for her. Since I was born in 1964, I do not have a birth certificate and hence provided 2 affidavits from my uncle and aunt who knew of my birth. Do I have to get anything else to prove my relationship to my mother? I also submitted my marriage card which mentions my mother’s name. Should I have my mother give an affidavit also?
2) In my mothers case she was born in 1933 and obviously does not have a birth certificate. She has a transfer certificate from her school which mentions her birth date according to the Malayalam era which was subsequently translated. We have rec’d a letter from USCIS mentioning that we need to get a non-availability certificate. Can we get that from the Indian consulate in NY.
