Form I-864 & I-864A

  • Form I-864 & I-864A

    Hello everyone,

    I am the petitioner and I filed I-864. However, my income is not enough so my dad who lives in the same house filed I-864A. I have 2 questions.
    1. My dad files tax return as “Married file jointly” with my mom who is living in the same house also. Does my mom need to file I-864A even though I don’t need to count her income. Just my dad and my income is enough.
    2. When counting household size in I-864 form, should I count 3 (My dad, the intended immigration and myself) or I need to count 4 (My dad, my mom, the intended immigration and myself)

    1. Your father would file. You mother doesn't need to file separately.
    2. Household size is anyone who is filing the form + any dependents (your mom, siblings, etc. on tax returns) + immigrant + any children of immigrant being sponsored.

      On my dad's I-864A, Part 4, line 2abc. It asks for "My total income for the most recent 3 years". Does it mean my dad individual income as in W-2 or the combined total income of my dad and his wife since they file "Married filling jointly"

      Also, in case I put down wrong number, can I upload an additional I-864A for correcting that mistake because I already submit I-864A

        He needs to put the exact number on the "total income" line from his tax returns from the last 3 years, regardless of whether he filed jointly or separately. So if he filed jointly, that number would reflect the total income of him and his wife.

          I recently submitted the wrong one. Can I upload a new I864A and resubmit as an additional document?
