  • AOS versus CP when I 140 is withdrawn

    Hi

    I am currently in the I-485 stage(AOS). Recently my GC sponsor withdrew I-140 due to which USCIS sent me an RFE to revoke my I-485 . I found a new employer who issued an AC 21 letter which was sent as part of the RFE response. This response is currently pending with USCIS.

    Currently I am in India since last few months . Due to some personal reasons I may not be able to go to US and work in the next few months. My AP (Advance Parol) expires on 18th June. I understand Consular Processing (CP) is an option for people are who are outside US. However, in my case, can I switch to CP from AOS at this stage. I am being told by a lawer that since my I 140 is withdrawn , I can not apply for CP now and that I have to return to US to continue my AOS status.

    I need help to answer the following question ?
    If I-140 is withdrawn, but AC 21 filed with a different potential employer, do we have an option to switching to CP ?
