  • Help - Family based green card consulate interview

    Hello All,

I am a US citizen and applied for a green card for my parents in 2019.

On 7th January, 2020, my mother was scheduled for a consulate interview but due to personal circumstances, she was unable to attend the interview. Upon inquiring at the Mumbai consulate, I was informed that her file will be kept open for a year (until January 2021) and she can appear for consulate interview in a year. However, due to COVID-19 and current US visa restriction, she was unable to appear for a consulate interview. One year is approaching this January (2021) and COVID cases are increasing in India. I am afraid that her file will be closed.

Please advise on how I should keep her file open so when circumstances improve, she can schedule a consulate interview for her immigration file.

    Thanks,
    Nandish Patel

Unfortunately, Covid closure restrictions no longer apply as most operations in India and Mumbai have return to normal and it's been few months already I guess since the US Consulate in Mumbai has resumed normal or restricted operations. So I don't think you will have too much flexibility in getting it extended much. You may have to contact/ write to them and see what options you have.

Also, the immigration and visa system is a computerized system and the deadlines are strictly enforced as per the immigration laws. Unless USCIS has widely determined that there's a need to extended the deadline in cases like your mother's, you won't have much choice and will need to get your mother in before the deadline. Otherwise, her petition will be determined as abandoned and you may need to start all over.
