  • CR1- conditional residency

    Two quick questions:

    1) If I enter the US for the first time with my immigrant visa, at a date which is after my 2 year marriage anniversary, will I still be given conditional residency? When my spouse applied for me (I-130) we were married for 1 year, at the time of consular interview we will be married for 1.5 years.

    2) Is it necessary for my spouse to be present inside the US (or travel together with me) when I first enter US with my immigrant visa?

    Thanks in advance!

    1. No. If on the date you enter the US with your immigrant visa, you have been married for 2 years, you become a non-conditional permanent resident, and you will receive a 10-year card with category IR1. If you receive a 2-year card, that is an error and you can get it replaced for free.

    2. No

This is my personal opinion and is not to be construed as legal advice.
