Is Mumbai consulate scheduling interviews for IR5 (Parent of a U.S. citizen)

  • Can anyone please let me know if I can apply for Direct Counseling Filing if my daughter (US Citizen) is staying in India or DCF is only applicable for spouses? Apologies for trying to find out if there is a way we can apply for IR5 if the petitioner is staying abroad and trying to establish a Domicile in the USA in the near future, like going for MS.

        Once he turned 21 we applied for IR5 - my son as petitioner/primary sponsor. As son not having income that time my cousin stepped ahead as joint sponsor. Joint sponsor need in 2nd stage (i864/DS260) of application process. For 1st stage i130 filing you don't need joint sponsor details.

        My understanding is petitioner, joint sponsor should be living in US but please check on this. I might be wrong.​

        What Are the Requirements for the IR-5 visa?



        To be able to be qualified for the IR-5 visa, there are conditions that both the U.S. citizen and the parent of the U.S. citizen must comply with. These conditions are as follows:
        • The U.S citizen must be at least 21 years old
        • The U.S. citizen must be financially sound to be able to sustain his/her parent up until the parents started working
        • The U.S. citizen must be residing in the U.S. and has a valid U.S. address
        • Parent/s must be from a foreign country
        • The U.S. citizen and their parent must show a valid birth certificate to prove their relationship

        • Having a permanent mailing address in the United States
        • Other proof such as evidence that the sponsor is a student studying abroad or that a foreign government has authorized a temporary stay
        I had similar situation. my kid registered for absentee ballot and voted twice. Also, opened US bank account; took State ID with my friend's home address.

          • With my parents planning their move to US, I would appreciate any insight into the following:
            1. Is there a limit to how much money they can wire to US (at any given time) or in total over multiple transactions?
            2. If anyone has worked with an accountant they can recommend advising on tax implications and filings, etc that will be very useful. Especially if in Northeast US.

                  Dear Aanedo,
                  The limit is $ 250000 in a year. You need to have a NRI or a NRO account. Hire a chartered accountant, get the forms 15CA and !5 CB completed and uploaded on the Income tax site of the person intending to send the money to his own account in the US. Minimal charges are levied if one sends money to his own account in a US bank. Sending anything more than 10000 to some ones elses account will attract gift tax in the US. Best wishes.

                    I think, you can't use Direct Counseling Filing.

                        I am a US citizen, had applied for GC for my parents last year. My parents have just received notification of interview for their immigrant visa in Mumbai consulate for end of Sept. I had these questions -
                        1. Does anyone have experience rescheduling interview for a later date?
                        2. How to get an appointment for biometrics at Mumbai consulate for both parents? Should I create 2 accounts , one for each parent? I tried the "Add by Name" option, it keeps erroring with message that this info matches with another applicant.
                        3. I am guessing that we get the biometrics appt for 1 or 2 days prior to the interview date. Does it matter how many days in advance we get the biometrics appt done?

                        Appreciate any inputs.

                            1. Do not try to postpone the date of interview. If you wish to do that, then you must wait until, after the due date. Then to try to find a slot. Let me caution you that the next available date may well be six months away. People from this forum have rescheduled but only due to the medical reasons (people required to take the sputum test). My advise, once again, do not try to postpone.
                            2. Creating one account is enough. I started with my own account than added my wife.
                            3. Biometrics should be scheduled at least two days prior to the interview. You can do it now, if you so desire. You can schedule the biometrics immediately after you get the IL.
                            4. The medical must be scheduled at least one week prior to the interview.

                              There is no problem if one parent wants to return to India. Just ensure that the stay in India is strictly less than 180 days. Best wishes

                                Thank you AlienKanpur! Appreciate the response. The website does not allow me to add another applicant. I keep getting this error. I have verified that all fields have valid information. None of the data entered matches with data for the other applicant including email addr & phone #. Not sure what I am doing wrong here. Any suggestions how to resolve this?
