I want to share our experience for my mothers interview process on July 27 , 2023 at mumbai
my mother and my masi stayed in trident which is near to both biometrics center and visa center . my mother reached mumbai on 26 july at 9 am for 2;30 pm biometrics appointment . The staff at trident is extremely courteous and they checked in at 9;30 am inspite of usual check in time of 2pm . As it was raining heavily in mumbai my mother reached biometrics center at 1:45pm and the guard let her and others inside the facility and she was done with biometrics by 2;10 pm . The process is fast .
The next day mom reached visa center at 6;45 am for 7;30 am appointment and she was led inside by 7 am . At first counter the officer checked her birth certificate , PCC , DS - 260 and my fathers death certificate . He said everything looks in order and gave her a token number and asked to keep the TAX documents ready for interview . She waited for 1 hour and she was called for interview she asked for a punjabi translator at the first window where documents were checked and she got one . The following questions were asked at the interview :
1. Who is sponsoring you ?
2. Where does your daughter live ?
3. does she work? (which is ironic since I'm the only sponsor for her )
4. How many children she has ?
5. What's her husbands name ?
6. When did she go to US ?
The officer kept looking at the computer while asking questions and the translator was translating and mom was responding . He didn't see any tax documents as i had uploaded all the updated docs to the CEAC site a week ago . But i still asked mom to take printouts for everything we submitted .
after the interview was over my mom was handed over the paper saying your visa is approved and to pay immigrant fee when you receive the visa as A number and dos id is no the stamped visa.
I'm grateful to everyone on this forum for sharing their stories and responding to queries . You all truly ROCK and God bless you all .

Thank you for the response Jasmeetkben Since the date of interview is so close, I am not sure if I will be able to get certificate of non-availability and affidavits on time. While submitting documents for DS-260 I did not upload any document for my mother’s birth certificate and I just added a comment that the certificate is not available and her case got DQed. I hope they dont ask me for these docs at the time of interview since they already DQed this case. Did they ask your mother to give any documents related to her birth certificate at interview?
I am surprised that the I-130 petition got approved without the documents of the proof of birth for your mom. When I applied, it was suggested by our attorney that we carry a certificate of non-availability and two affidavits from people, at least 10 years older, who could certify about the birth. The originals were submitted at the time of the interview. Once the i-130 gets approved then getting DQed is generally routine. They will in general accept that a certain document is not available. Like in my case, I did not have a PCC. But the application got DQed. In the mean time I got a fresh PCC. So as suggested by Jasmeetkben, it is advisable to get these three things otherwise you may be handed 221(g). Best wishes

AlienKanpur than you sir ! I’ll pay the fee as soon as we get stamped passport . I can’t wait for mom to come stay with us . It’s been long and tedious process but we’ll worth it because the reward is rewarding 🙂

Birth certificate is one of the most critical documents along with PCC for the IR5 visa interview . I hope and pray that yours gets overlooked and visa get approved . But I still suggest get the affidavits and it’s just a half a day process not much in it if you can’t get non availability certificate . Although my mothers year of birth is 1967 which is before 1970 as mentioned in us travel site we didn’t want to take any risks and be extra prepared and hence the non Availability certificate and affidavits. But I think there’s slight chance it’s not required since they themselves mention that persons born before 1970 the birth certificates are considered unavailable .
and yes the first document asked by officer was Birth certificate(followed by PCC , DS-260 and Fathers death certificate ) which instead we had as non availability certificate and 2 affidavits from older relatives.

Could you please suggest me the process of obtaining certificate of non-availability? Also, is it possible for you to share the format & content of availability of affidavits you got?

Thanks, Jasmeetkben.

Just go to the local Tehsil office and there are many Lawyers sitting there to do ALL this documentation immediately within 2 hrs for a nominal fee. Please be advised that all such documentation is now done ONLINE in India, so it does not take much effort/time. In fact, with so many people going abroad from India, therefore, these lawyers are well-versed for any such requirements. I got mine done similarly. The first items the Consular Officer asked were my Birth Certificate, PCC and latest ITR. Best wishes for your respected mother's adjudication.Last edited by asg1957; 08-01-2023, 11:59 AM.
