  • 221g denial on IR5 Consular processing interview

    My mother (age 75) had an IMMIGRANT VISA interview on July 7th, at Mumbai US Embassy. My mom does not speak much English so we had a translator. The person who was assisting my mom could not find some papers that the officer was asking for and my mother could not provide two documents/ or explanation. She was issued 221g denial letter asking for submitting two documents before they reconsider.

    1. Police Clearance Certificate
    This PCC certificate was in the physical file but somehow the officer was fumbling to find it. My mom did not understand whether the officer said if the certificate was not found OR if the one she brought with her was unacceptable for the purpose. We made one mistake that we had forgotten to upload a softcopy of her PCC on the CEAC website (in documents section) since that document was obtained much later during the whole green card process. My question is do you think our PCC obtained from Maharashtra government site for Mumbai is valid? We had made sure that we specified purpose as Immigration at the time of that PCC application

    My mom had obtained PCC from applying to Maharashtra state government site. We had researched that there are two ways to apply PCC - one is from regional passport office (passport Seva kendra website - https://www.passportindia.gov.in/App...e/pccOnlineApp) and other one is from Mumbai district police commissioner's office near the place of our residence (https://pcs.mahaonline.gov.in). We had used this later option to obtain PCC.

    2. Approval notice I-797 for extension of stay
    My mother came to visit us on visitor visa in 2021. In August 2021, she applied for extension (I-539) due to covid lockdowns everywhere. We received I797 receipt notice of her application followed by fingerprint/biometric appointment in January 2022. After that before we even received any approval from USCIS, my mom left the country to return to India on March 2nd 2022. After coming to India, we sent correspondence to USCIS that my mother has already left the US and arrived in India. USCIS acknowledged it and then they never wrote us anything so I guess they closed the file for I-539. My question is if this is sufficient or will they raise an objection for stopping I539 in the middle?


    ACTIONS I HAVE TAKEN AFTER 221G letter was issued

    1. uploaded a softcopy of the PCC certificate on CEAC website

    2. uploaded softcopy of I539 papers/documentation on CEAC website

    3. I am thinking of uploading a letter on CEAC to explain what happened with I539 and why We never received any I797 APPROVAL notice. Any suggestions on how to approach this letter

    4. Go to dropbox and submit hardcopy of 1, 2, and CURRENT INDIAN PASSPORT along with 221g letter.



    My questions are:


    1) Is our PCC considered valid? Applying to PCC all over again to the regional Passport office takes a month end to end.


    2) How long will they take to process/approve GC once we put above documentation in DropBox?


    3) She already has tickets to leave India on 8/19. Our preference is that she travels on green card (after obtaining I551 stamp in her passport). There is no one to care for her in India after that date. Can she travel on visitor visa considering that we are in the middle of this situation (middle of green card process and that there are questions on prior I539 stay)?

    You have three questions.
    1. PCC: you have to have PCC from passport office only. NO OTHER PCC WILL BE ACCEPTED. Take appointment at PSK and pay Rs.500 as fee. On the day of appointment it's a matter of 20 minutes only. PP copies, Aadhar card copies and pp photos. Next day it will be in nearest police station. Phone them and inquire and go personally. They will verify and send the report to Passport Office and PP office will send a PCC by speed post to your home address. Max 15 days.
