  • Regarding I-539 denial

    Hello there, I arrived in the USA on February 2010, on July 2010 I applied for an extension of stay and got denied. the denial was decided on September 1st (B2 status was over August 2nd) and I found out on September 15th. I left the country on September 28th so I did not overstayed the 30 days.

    My question is - to what address do I need to send my letter containing the proof I have left the country (boarding pass original denial letter explanation letter etc..)?

    and also, I have read the article you have posted on the matter (a real life saver that was!) and I did not quite understand- even if I did overstay my B2 status it was because of USCIS processing , once I got the denial I left before 30 days so is my multiple entry visa still voided??

    Please answer, I would really appreciate it - the reason I applied for an extension was because I have been accepted to college in the US for the Spring semester meaning I need to get my F1 visa ASAP and that would not be possible without the multiple entrance visa..

      Thank you very much for your answer!

      BTW- is it even necessary to have a multiple entrance visa if I apply and receive a student visa? I mean I could legally enter the states with only my student visa without having the multiple entrance one?

        If you have a single entry visa, you can enter the U.S. only once. If you want to enter the U.S. multiple times, you need multiple entry visa.
