  • Need help with I-864

    Dear Forum Members,

    I recently received approval for two separate I-130 applications for both of my parents and am now in the process of filing 2 separate I-864 form for their IR5 visa application. However, I'm encountering confusion with certain sections and would greatly appreciate your guidance.


    1. Part 2:
    a.) For the mailing address of the principal applicant, should I provide the US mailing address where they will be staying or their current home country (India) mailing address where my parents currently reside?
    b.) Column 7: Should I input my phone number or my parents' phone number?

    2. Part 3:
    Should I select option 1 or option 2? If I choose option 2, do I need to enter the names of both family members?

    3. Part 6:
    This section is particularly confusing. I am married and live with my wife. Although I have sufficient income alone to sponsor my parents, but I file taxes jointly with my wife.
    a.) When filling in column 7 of Part 6 for income, should I input my income only?
    b.) In column 20, should I mention the total household income, which includes my wife's income as well? Should I also file I-864A along with I-864 since we file taxes jointly?


    I understand these are quite detailed inquiries, but any assistance or advice would be immensely helpful. Thank you all in advance for your support.

    Check Yes in item 1. Do not check the boxes in items 2 or 3. Those are for derivative beneficiaries, and there cannot be any derivative beneficiaries in their category. They are each principal beneficiaries of their own petition, and item 2 says, "(Do not include any relative listed on a separate visa petition.)"

    Item 20 is just the sum of items 7, 10, 13, 16, and 19. In fact, Adobe Acrobat Reader will usually automatically calculate it for you, without you needing to enter anything yourself. If your wife did not file I-864A, and thus you do not list her as "Person 1" (Part 6 items 8-10), then item 20 will just be equal to item 7, which is your own current salary.

    ​Not unless you need to include her salary for the household income to be enough.
