  • Guangzhou - 221(g) Question

My wife is from China and is a US citizen. We are trying to get a green card for her mother so she can move here. Her mother had her final visa interview at the US embassy in Guangzhou today, and her visa was only denied because they needed proof of when my wife changed her last name when we were married. They gave her a 221(g) form with instructions on how to submit this document. We don't really have a document per say. We have our marriage certificate, which they did not accept. Her last name was changed during her green card interview. At her green card interview, they asked her if she wanted to change her last name to mine at that time, and she said yes. They made the change and issued the green card in her married name. There was never a document saying that they changed her name, but we have the letter asking her to appear for the green card interview in her maiden name, and then the letter saying her green card was approved in her married name. We also have copies of her Social Security card and driver's license showing the before and after names. Can we just submit these documents as proof, or do we need to go to a court and get some official document saying that she did change her name either when we were married or during the green card application process? I know there is zero chance that we could contact the local office in Texas that did her green card interview and ask them for anything.

I appreciate any advice that anyone can give me. This is the only thing holding up her visa to come to the US.

    Thank you!

In your case, since the name change occurred during the green card interview process without a separate court document, you can submit the following as evidence: suika game

Marriage Certificate: Even though it was not accepted initially, include it again as it is the foundational document for the name change.

Green Card Interview Letters: Submit the letter that invited your wife to her green card interview in her maiden name and the approval letter in her married name. This shows the name change was made by USCIS.

Social Security Card and Driver's License: Copies of these showing the name before and after the change can serve as additional proof.

Additionally, you can include a cover letter explaining the situation in detail, stating that the name change was conducted by USCIS during the green card interview process and that there is no separate court document for the name change.
