      Domicile of sponsor and other issues

      I have a few questions relating to the Affidavit of Support I-864 that I wondered whether anybody here might be able to help me with.

      I'm applying for an immigrant visa from London. My wife is American and is acting as my sponsor. She is currently a student in the UK, but we're planning to move to the US together as soon as possible. She has an address at her family house, has maintained several bank accounts, and has filed tax returns (although she hasn't been employed) in the US for the duration of her absence.

      Having read the guidelines on the I-864 linked above, this seems to be OK for the purposes of having the application cleared, but I still wanted to check whether there might be any potential problems or other issues I need to be aware of before I go to the Consulate for my visa interview.

      I've already emailed the consular officer with these questions. and basically got the official line back that my wife had to sign a lease, put her kids in a US school, or the like, to show her intent to move there. This, of course, is difficult, seeing that we have no kids and can't sign a lease before we know for sure that we can move to the US and/or are actually in the country. I explained all this in my initial email, but nevertheless got back that stock answer, which I already knew from having read the I-864 instructions.

      My question is whether the fact that my wife clearly has maintained ties to the US as outlined above is sufficient for my application to be approved, or whether we need to take additional steps to demonstrate our intent to move to the US together.

      Any advice or comments would be much appreciated. Thanks so much.

        I am in the EXACT same boat!! I am a US citizen and my husband is British, we've been living in the UK and have just sent our I 130 to go back to the States. From what I've read, once we get an interview date the I 864 needs to be sent in - and the petitioner is meant to be the sponsor (which is me) - but I'm living in the UK and the sponsor needs to live in the US! I'm so confused.
