My I-140 was approved in April-2010 with company A. Because of a dispute with company A, in June-2011 (i.e this year) I switched to company B and now I came to India to get my H1B visa stamp with company B. But I am struck here with 221g Admin processing.
Company A didn't cancel my I-140 and I know they are willing to accept me anytime if I want go back to them. Now that my priority dat is current, I would like to proceed with company A GC process. To do that, I know a form I-824 should be filed to USCIS. Can I file this on my own or does my previous employer (i.e Company A) has to file ?
What is the usual total timeline from the day I file I-824 till I get an interview date at a consulate ?
When should I get a notarized job offer letter from Company A ? Is it needed for filing I-824 or is it only needed for the CP interview ?
I would really appreciate the comments or suggestions from attorney's or gurus in this form.
Many thanks
