Hi,
We are about to file a waiver for my wife's IR-1 visa application. She came to the US on a K-1 visa and we got married a few days after she entered the country. We lived in the US for about 2 years and didn't file the AOS. Now, we are back in her home country due to a family emergency visit. We spent enough time waiting here and want to go back to the US together as a family. Does anyone here know anything about the waiver, what they will consider or not for the approval, how long it will take, and other issue that might come up.
More info, we had file the petition for the IR-1 and it was approved, then we went ahead to file the IR-1 visa, the consular said the we need to file a waiver as well.
