In 14th JAN 2011 I applied for b1 visa at the time I wasn’t familiar with the us immigration system so I had given my detail to an agent who was not qualified or attorney but he had the experience about b1 visa even he had many clients
Now he fill ds-160 form on behalf of me and submitted at this time I does not have any information that what information he has written in the form and I got 214b
So I told him to apply again immediately so he again sent same form to the consulate, and at this time I received 221g notice during my interview, and my case went pending,
After few months I applied for EB-5 visa and received the approval from USCIS I did this petition by myself only,
Till this time my case b1 case was in under administrative processing and it was almost 14 months has been completed so I sent request to withdraw my case and my case was withdraw successfully.
Finally I got call for interview of EB-5 and when I reach the interview the consular said your visa is been approved but when I receive my passport with I received a letter of 221 saying that provide the divorce or marriage certificate
It was surprising things for me because I never married till today even I double checked my all document which I have submitted to USCIS, NVC and consulate everywhere I ticked that I am single but still consulate asking me about my marriage status, so I became suspicious about my b1 application immediately I asked to my previous agent to send copy of my previous ds160 form, I reviewed the form and I knew that he has mentioned in the form that I was married with the girl XYZ
Actually when I applied for the b1 visa at the time there was a girl name was XYZ, in my life she was my blood relative and cousin sister. In my religions we allowed to do marriage with cousin sisters also but I am broad minded person and inspired by western culture so wasn’t prepared to get married with the girl but my family was expressly disagreed of this and they are in favor of this marriage. Finally my family decided to fix my marriage date of Dec 2, 2010. They were very happy and started preparation of my marriage my family members spread news about my marriage to many relatives and people who know me but the date was delayed and rescheduled because at the time my brother was in London for study purpose and he was not able to give his presence at the day of my marriage because of his study so my family members reschedule the date of my marriage on Dec 25, 2010, because of this reasoned many people are started to spread many bad and good rumor about me and my marriage.
Because of conformation of marriage and the blood relationship with the girl and because of happiness of my parents we were living same as a couple live.
Finally when the girl realize that I am not feeling same as she feel at the time we both decide to change our life partners happily and we explain our circumstances to our family members and convinced them about the situation and happily we ended our relationship 4 days before to our marriage. Still today we have great relation sheep with their family. But
Thus I was in relationship but wasn’t married ever with this girl but many people were thinking that I was married even some of my employee also thinking that I was married but in fact I wasn’t even because of this misunderstanding the visa agent mentioned me as married in the form also he has included her name, actually I have invited the agent to my upcoming marriage and because of his friendly attitude he was very close to me.
agent filed my application at 5th Jan 2011 at the time he was not aware about this issue even because of all this personal matter i was very depress so i wants discuss with him even so he tick that i am married and also mentioned her name in the form, for my b1 visa and today i am getting this information that he mad mistakes
Now consular is asking me about the divorce or marriage certificates what should I do?
1> Should I send them detail explanation about my circumstances?
2> I am able to get affidavit from the girl too about this issue should I submit it?
3> Need your expert help
4> What to do?
5> Can any body give me some advice?
