1) My husband claimed as head of household on his last tax return and listed his niece as a qualifying person since she was residing with him at the time. However he did not claim her as a dependent because he was not supporting her. Does he still have to count her as part of his household size on the affidvit of support, since her name is listed on the tax return ? His niece is under 21.
2)He was never married to his children's mother and they never lived with him. Does he have to count his children as part of his household size?
3)Seperate form I130 petitions were filed for myself and my 3 kids. In that case a seperate I864 Affidavit of Support has to be completed for each person. When counting household size do you have to include the total number of persons a seperate form I864 is being completed for on each others form or is it only the principal immigrant since we are not yet lawful permanent residents and we do not reside in the U.S? eg. sponsor-husband (1) + principal immigrant (1) + dependents -kids with seperate petitions (3)=5 or sponsor-husband (1) + principal immigrant (1)=2
4)question 23 on AOS- Current individual annual income. Do you state the income that is expected to be made for this year or do you state what is listed on last years tax return?
5) Form DS230 immigrant visa application #24 - mother's family name at birth. Do you state the mother's last name at the time of the visa applicants birth or is it the mother's name at the time of the mother's birth (maiden name)?
