PIO Card for New Born Baby

Hi,
I want to apply for the PIO for my baby (new born) but I and my wife does not have the valid visa means my VISA and I-94 has been expired on Septemeber 14, 2012. My company has applied for my Visa extension (I have a letter for proof) and it is under process.


My question is this, Can i apply for the PIO for my baby in this condition.

You should apply for her PIO card after your visa is approved.

Otherwise, Indian consulate will give you hassles about it as they may not understand all the legalities of US immigration matters.
