  • I-94 Renewal with Name Change

    Hello -

    I am currently working in US on L1 Visa. I have few questions related to passport renewal/I-94 renewal:

    1. My Passport is expiring in Feb-2014 and hence I-94 is also expiring in Feb-2014. I am planning to get my Indian passport renewed in Chicago. I also plan to add my spouse's name. Can I get a new I-94 issued after my passport renewal? Where can I get this done? Do I need to travel outside of US to get new I-94?

    2. My spouse is on L-2. Her passport is expiring in Aug-2014 and hence I-94 is also expiring in Aug-2014. Currently her Indian passport and L-2 visa are on her old name (as we had to travel immediately after the marriage). Can I get her passport reissued (and renewed) with the name change in Chicago along with mine?
    We do have a marriage certificate with us. Do we need to get visa also changed with the new name? Can we get a new I-94 issued after her passport renewal with her new name? or will this (changing the name) create any issues for us?

    1. You don't need new I-94 after passport renewal. In any case, you will get new I-94 when you are travel outside of North America and come back.

    2. She can get the new passport from Indian Consulate in Chicago with her new name. That itself would not get her new I-94. She would travel with both the passports, proof of marriage. When she enters the U.S. again, she will get new I-94 with the new name.
