I am planning to apply for a PIO Card for my newly born baby. But I have some concerns after going through the eligibility requirements. The relevant details are given below:
Baby's DOB: 2013
Baby's Citizenship/Passport: USA
Father's citizenship/Passport: INDIA
Visa: H1B (Valid till 2014)
Mother's citizenship/Passport: NEPAL
Visa: H4 (Dependent. Valid till 2014)
My concern is that the BLS website states that "Further, if the applicant himself or either of his parents, grandparents or great grandparents held the nationality of these specified countries at any time, he will not be granted PIO Card." . The list of countries include Nepal. After reading this I checked with the Bureau of Immigration India and as per their website we seem to be okay.
But I am looking to the community for a feedback on the following questions.
1) I would like to know if we can apply for the PIO card for our baby?
2) If not, what option do I have for a long term stay in India. (We are planning to go back to India permanently in a year or so. I think we should have applied for the Indian passport but now we already have the US Passport.)
