    Hi everyone,
    My daughter was born in India on Dec 09, 2002 and I was and am the only US Citizen parent. She just came here to USA on green card on April 11, 2013. she was in India between all this period. She could not become automatic US citizen by birth as
    1) I was the only US citizen parent 2) I was not physically present for 5 years before I got naturalized.
    So in order for her to be a US citizen she had to enter the US as permanent resident and become an Automatic Citizen on the date of admission into USA.

    This all is according to the CHILD ACT OF 2000 which applied on her. Now I have applied and got her a US passport on May 21, 2013 , without going through naturalization process. I would like to add here that the passport issue date is not a proof of the date of acquisition of Citizenship.

    Now I have applied PIO card for her through Travisa a month back and they returned my application asking me to pay penalties in the amount of $1000. Saying that she did no surrendered her Indian citizenship on time and traveled on Indian passport. I have explained them that she just became US citizen on the date she entered US and was not a US citizen by birth, but they did not listened and kept asking for penalties which I did not pay. So they returned my application. Now they are no longer in service and I have to go through BLS International in Houston for the same.

    I also went to USICS via infopass and explained them the situation and asked to give me some document which shows the effective date of my daughter's Citizenship. They are helpless in that regard and advised me to apply for Certificate of Citizenship which I can but it takes a year to process that here in LA and it would also cost me $600 unnecessarily.

    Please help me in this regard. I will soon be going to BLS International in Houston to apply PIO card again.
