apply for passport reissue with i94

I am planning to apply re-issue of passport through BLS.

one of document proof they are asking is, "Notarized color photocopy of current valid US visa on passport or Green card or Employment Authorization Card or I-797 approval notice documents."

I don't have valid visa now. my visa got expired on dec-2012. currently i am on I-94 validity period. my I-94 is getting expired on Nov-2013. my passport will also getting expired on Nov-2013. i am planning to apply re-issue of passport (my passport is almost 10yr old). BLSIndia is asking valid visa or Employment Authorization Card for re-issue of passport. i don't have either. can i use my I-94 as employment authorization?? would blsindia reject my application if i do so???

Yes, you can use unexpired I-94 and I-797 notice of approval as the proof of legal status in the US.

They don't understand the US visa system well enough.

Therefore, you may have difficulties probably.
