  • PIO Card /Tourist VISA or Entry VISA - Pls Advise

    Hi,

I tried to search for some advise for my case but i couldn't find anything appropriate. Please show the direction if any suggestions/advise are already there. Thanks for reading this.

I am in US with H1-B and my wife is on H4. My VISA got expired on Oct 6th 2013 and and i have applied for extension in Sep 2nd. Till now the case status is in intial review and through friends i cam to know that recently it is taking more time to get that approval/rejection.

I have a new born and i have got the US passport for him but when i applied for PIO card, BLS is asking to attach the extension approval notice which i haven't got that yet. what happens when my extension is rejected?

I have a family emergency in india and thought of sending my wife and kid through tourist visa but i'm not sure whether i can apply for PIO card in India itself?? I tried searching for the documents of entry visa and even for that BLS is asking VISA approval notice. Please advise. Thanks.

You can apply PIO card for your kid with your valid indian passport itself, which can very well done by india itself. you have to visit FRRO office in india. It does not related with H1B VISA you have. you should submit following items to get PIO card.

    a. Valid US kid Passport.
    b. Your valid passport which includes your spouse name.
    c. Your marriage Certificate.
    d. Birth Certificate of your kid.
    e. Filled PIO application form.

      1. Should the Birth certificate(from US) of the kid be apostiled from US or just the birth certificate is good enough.
      2. My passport has my home town address in India but now I have settled in City. Should i provide address proof of the new permanent address.
      3. My wife's passport dosent have my name, it still has her father's name as surname. is this fine as I think we are anyway have to show the marriage certificate.
