PIO Card if one parent has Approved Visa and the other is under Extension

Hi,

Our son is born in the USA and we want to get his PIO. My Visa is expired and extension is filed for. It is not yet approved. But my husband has his Visa approved. In this circumstance can we get a PIO?

According to some consulates both parents need to have a valid visa. You can try your luck.

Recently I applied for pio and got it for my baby. i believe both should be in status visa expiration doesn't matter. but valid status is imp. approval notice is fine. my visa page also expired last yr, but i am in valid status.
