Hello Everyone,
My wife and I are Indian citizens. I am in US on L1 Visa and my wife is on L2 visa. We are blessed with a baby girl two and half months back in US.
Our visa stamps are expired on 2nd Jan 2014 but I am having valid I-94 till March 2016 but my wife's I-94 got expired (we traveled on different dates).
My employer filed extension for her two months before her I-94 expiry/visa. It is still in "initial review" stage on USCIS website.
My wife and baby want to visit India next month. I know we can not apply for PIO card as I have seen many post says that it got rejected even with valid I-94.
Can we apply entry visa for my baby with my valid I-94 and USCIS notice letter (I797C), stating that they have received our application for my wife's visa extension ??
if not then what if her L2 visa extension got denied ?
Please help and advise me.
