Hello all,
First time poster on these forums. I have a strange dilemma. Me and my wife are moving back to India, with our child on the way in about 7 months. My wife is a US Citizen with a valid OCI, and I am a green card holder (will renounce my GC after I move back). We have understood the process for CRBA to apply for child's US citizenship after the child is born in India. There are a few questions we are trying to find the answers to, but have been unable to do so till now. It would be a great help if someone who knows the process can guide us.
a) Can a child born in India, but who has a US passport be eligible to apply for OCI in India ?
b) If yes, what is the process and what documents are necessary?
c) Do both parents need to be OCI holders for child to have OCI?
d) Is PIO a better option for the child since father is an Indian citizen?
e) Does the child need to take exit visa and leave India before applying for OCI abroad?
f) Is there anyway a child to stay in India on 10 year reentry visa if OCI/PIO cannot be obtained?
g) Does the child need to take a visitor (or equivalent) visa to stay in India?
