We have a 8 months old us born and in process of applying PIO card for her.
My Wife has a valid H1B. I had to convert to H4B because of max-out on my H1B. My H1 to H4 'Change of Status' application is pending so I have the receipt notice and NOT an approved H4.
Can we still apply for PIO Card for the baby, if one of the parent has valid H1 (valid I797) and other has H4 pending?
If PIO card can not be applied, can we apply for an Indian VISA with a H4 pending?
