My passport expires in about 6 months and I want to apply for the renewal at the Washington DC center. I will have to mail the documents since I live in North Carolina. I want to get my passport renewed as early as possible because I may be going on an H4 from H1B soon. My husband's passport is however expired. Would that be a problem? Can I renew my passport before he renews his? Also, is the original marriage certificate required or a copy notarized in India will be fine? Thanks for the answers!

Yours is a very tricky situation. Ideally, documents (including photocopies) sent as supporting materials should be valid and not expired. In your situation, if you are married and including your husbands name in your passport, you will definitely need his valid passport notarized photocopy for your renewal. For the marriage certificate, a notarized copy from India should be fine. You probably need to renew your husbands passport first before renewing yours, if you plan to include his name on the passport.
