I live in a middle east country. I'm a US citizen, formerly Indian citizen. My wife is Indian. Our infant son is a US citizen. My understanding, from everything that I've read online is that both I and my son are eligible for OCI. After a lot of effort to get the paperwork together and getting time off work to go to the indian embassy here, the person in charge told me that I am eligible to apply for OCI but my son is not because his mother is Indian. He said that both must be foreign citizens. I said no and showed him on my cell phone what it says on the govt of India ministry of home affairs website: that the minor child of an OCI parent is eligible. Hence, my son is eligible since I am eligible. He was nice but kept saying no... simply shook his head and said that they've received instructions that both parents must be non-Indian. Again I tried, saying that at least one parent must be OCI eligible. He shook his head. I asked him, where is it written that both parents must be non-Indian. He said that the embassy has received instructions. I said ok, let me apply anyway for me and my son and if he gets rejected then so be it..... but he said no he can't let me apply for my son. What can I do, I feel my right is being denied? Finally he said that if I can get it in writing from Delhi officials then he'll let me apply. He told me to tell them what the embassy is saying and then ask if my son is eligible.
