PIO for minor child of Naturalized US Citizens (and OCI holders)

    Hi!

    I am looking to apply for a PIO card for my newborn son. Both my wife and I are US citizens and OCI holders, and were previously Indian citizens. When looking at the conditions for eligibility I saw that the applicant (my newborn) has to have parents, grandparents or great grandparents who were born and permanently reside in India as defined in the Government of India Act, 1935, or any other territory that became part of India thereafter.

    Does this mean that our son cannot apply for a PIO using my and my wife's former Indian citizenship status?

    Of course, he can apply for PIO card.

      I was unsure because the conditions stated that the parents must be born and permanently reside in India as defined in the Government of India Act, 1935. Since we are US citizens and don't reside in India, I wasn't too sure.

      Secondly, I have my US naturalization certificate, but my wife does not. She gained US naturalization through her mother. What documents does she have to provide instead of the naturalization certificate? Will a notarized letter from her parents work? She has an OCI and Indian citizenship renunciation certificate, but has misplaced her old Indian passport. We will be submitting the application at the New York center.

        You don't have to reside in India right now. You (or your parents or grandparents) must have lived in India at some point and met other requirements.

        2.
        Your wife needs to apply for her naturalization certificate from USCIS. Form N-600, /show-form/n-600

        3.
        Regarding having lost Indian passport, I am not sure what to do. Please contact CKGS.

        You should look at the list of documents at New It is a lot easier to understand.
