PIO Card for new born - Awaiting for I-94 after change of status

  • PIO Card for new born - Awaiting for I-94 after change of status

    My husband and I were both on H1B status. Recently blessed with a baby girl.
    I was on H1B which was valid until 09/30 (September 30). So I filed a I-539 Change of status to H4 early september (based on my husbands' H1). As of today, still waiting for a response. From the USCIS web sites, it looks like its taking about 2 1/2 months for I-539 processing.

    My husband does have valid I-94 and also a valid visa stamp.

    we are planning to apply for PIO card or Indian visa for our new born daughter.
    From the CKGS website, it looks like we both need valid I-94 for applying for PIO card for our daughter. In that case, do I have to wait till get my updated I-94 ?
    What are my alternatives? If not PIO, what type of Visa (entry /tourist/?) do I need for my newborn to visit India?

    Hello,

    First of all Congratulations for your bundle of joy.
    If you are planning to visit India anytime soon, I would recommend getting a tourist Visa for your child. It would take less than 2 weeks to get the VISA and hasslefree.
    However if you have no immediate plan to go tto India, you can apply for her PIO card - but you have to provide the approval notice - a receipt would not work and your application would be rejected.
    So decide on what you would choose based on your travel plans.
