if I became US citizen in January 2005 and I took visa for 10 years and now I got my new passport and I found my old Indian passport was not cancel. Do I need to pay penalty?
I have not used Indian passport after it was renewed in USA?

some place showing if I became us citizen before May 2010 I don't need passport cancel certificate.

If you need to apply for OCI, etc. in the future, they will ask for proof of your surrender certificate and copy of canceled passport.
