Passport about to expire and need to travel to India. Pls help.

Hi All,

My wife's passport will expire in April 2015. We were about to get it renewed. However, due to an emergency she will have to travel to India immediately. She is planning to return after 3 - 4 weeks. She is on L2 Visa which is valid till April 2017. Here are my questions:

1) while returning, her passport will be valid for less than 6 months. Will she be allowed to re-enter US with a passport of a validity less than 6 months ?
2) If she is allowed to re-enter, how long will she be allowed to stay (I-94 validity).
3) Is it advisible to get the passport renewed after returning ?
4) Since she is planning to stay for 3-4 weeks, is it advisible to renew the passport in India itself.
5) If she gets the passport renewed during her stay in India, will there be any complications with regards to the visa.

Appreciate any help on this regard.

1. Yes. Indian citizens are exempt from minimum 6 months validity.
2. That will be according to the date when your L petition expires. That is, based the stay you are allowed.
