Which Indian visa will allow for OCI application for a minor while in India?

  • Which Indian visa will allow for OCI application for a minor while in India?

    We wanted to get OCI for our USA newborn daughter. Unfortunately our visas are expiring in Apr-2015. We have I-94 status till Sep-2016.

    The updated checklist on CKGS needs us to have a USA visa which is valid for at-least 3 months. I called them and inquired about my scenario - but they are insisting that I would need a valid visa - I-94 status will not be considered.

    Does anyone know which visa I should take for my daughter to take her to India and get her OCI done? After getting the OCI for my daughter would there be a need to travel out of India and re-enter to activate the OCI visa?

    I'm also in same situation. My H1-B is expired and have approved I-797.I called CKGS and embassy, they were saying YES and NO . is it OK to send I-797 approved copy instead of visa validity copies

      I'm also in same situation. I have approved I-797 and my H1B is expired. DId you know how to proceed

        Oci for minor

        We are in the same boat. We also need OCI card for our minor child. The PIO card (currently discontinued) requirement clearly stated that approved I-797 (H1/H4) for parents were enough to prove parents legal status in USA.
        How come OCI should have separate requirement? It is quite confusing. When UCICS has determined our legal status in US, how another country can determine the legal status based on their arbitrary understanding of the US law?

          I am going to be in the same boat in a few months... Really interested to know the answer. I wrote to the CKGS and they asked me to either extend my visa or go to India and get a OCI done there through FRRO. I totally forgot to ask about the visa type! Maybe, a visitor visa that is valid for 6 months should do, but, the question remains - would we have to take the kid out of India and reenter with the OCI card?

            VISA extn is a valid process here in US and not sure how INDIAN govt thinks status is not valid?!!?. There are 1000s ppl applying for VISA extn and how INDIAN govt folks are not aware of this!?

              I called CKGS and sent email. They said they are accepting I-797 A with valid I94 extension as Visa extension proof.You need to send expired Visa copy along with new I-797A. They dont accept I797 C which is a receipt notice or transfer notice and doesn't grant any benefit. Exact wordings for email reply are:

              Dear Applicant,
              Thank you for contacting CKGS via email.
              With regards to your query, you may submit you Visa extension as it is accepted at New York center.


              I am sending my OCI application tomorrow to NY center, will keep you guys updated.

                  Hi Gagandeep Sharma, could you please update if you got the OCI card. I am going to apply with I-797A as well, so was interested in knowing what happened.
