OCI for minor, parents on I-94 and approved L1 A petition

We are going to apply for OCI for our minor daughter. However, we had one question.

I the father of the child have I 94 (issued by US Customs and Border Protection, Department of Homeland Security) valid till October 2016. I-94 essentially governs and allows a persons legal and valid stay in the US beyond the Visa period. I came to US on L1 B Visa which ended in November 2013. However, as I have I 94 which allows to me stay legally in the US till October 2016.

Questions:

1) I want to know, if we can apply for OCI for our minor daughter based on the validity of our I 94 (I 94 is valid till October 2016) even though our Visa got over in Nov 2013?

2) We were informed by the CKGS agency call center that we need to have atleast 3 months valid visa to apply for our minor child's OCI. Please guide?

3) Please note further that my L1 A petition has been approved till Feb 2017. I have the approved I 797. Would it be sufficient to show that I am on valid visa in US for the purpose of OCI?

OCI is not issued for Valid I 94

I have applied for OCI on feb, currently I am in I 94 valid till next year with L1B expired last year. I got a communication from CKGS, that it can proceed with application without valid visa status.

Incase if your L1 A Petition is approved then your I 797 will be valid and sufficient for processing.

A CKGS, Atlanta official called today and he advised that the valid approved petition is sufficient. My application is already sent to India and is under process.
