A Canadian Citizen wants to apply for OCI -Separated spouse in India, not divorced.

  • A Canadian Citizen wants to apply for OCI -Separated spouse in India, not divorced.

    Hi, I am an India born Canadian Citizen. I landed with my spouse as a Landed Immigrant in 2011. Some how, my spouse did not like Canada and left Canada before 4 years (almost within 5 months). He never returned back to Canada and he is no more a PR of Canada. He does not want to give me a divorce and created a civil legal matter in Indian court. I have no contact with spouse.

    Meanwhile, I took Canadian Citizenship. Now, I want to apply for OCI. The OCI checklist requires spouse's landing paper and detail. I do not have any. I am still married - separated but, not divorced.

    Please HELP me what should I do???? Can I not apply for OCI at all??? I am really confused and lost.....

    Each and every help/feedback and advise are welcome....

    i am not an expert but I would have still applied without that landing document because you yourself are a Canadian citizen.

      If you have been sponsored by your Spouse, you will come under Family Class and to apply for OCI, you need your spouse's Landing Paper, otherwise even though you are a Canadian Citizen they wont accept. If you have landed in Canada before you got married, then its a different case, your own Landing Paper is enough.
