My wife and I are Indian citizens on H1b visas.
The OCI application checklist for my new born son has this:
VISA STATUS FOR PARENTS – ONLY IF PARENT(s) ARE FOREIGN CITIZEN(s) (NON US)
VISA MUST BE VALID FOR AT LEAST 3 MONTHS.
My H1b visa is valid for over 3 months. But my wife's visa expired last year. Her I-797 is valid for another 2.5 months and an extension is in the works.
Is the OCI application going to be rejected?
