Visa status for parents - validity for 3 months

My wife and I are Indian citizens on H1b visas.

The OCI application checklist for my new born son has this:
VISA STATUS FOR PARENTS – ONLY IF PARENT(s) ARE FOREIGN CITIZEN(s) (NON US)
VISA MUST BE VALID FOR AT LEAST 3 MONTHS.


My H1b visa is valid for over 3 months. But my wife's visa expired last year. Her I-797 is valid for another 2.5 months and an extension is in the works.

Is the OCI application going to be rejected?

Response from CKGS

Here is the response I received from CKGS. They seem to be willing to refund the fee I paid as I am unable to apply at this time.

Greetings from CKGS.

With reference to your email, we would like to inform you that both the
parents Visa or Approved petition should be valid for minimum of 3 months
to apply for OCI Card for the minor.
